Terms of Service
Last updated: 16 October 2026
These terms are an agreement between you (and the business you represent — "you", "Customer") and Indibuying ("Xporta", "we"), of 1198, 22nd Cross, HSR Layout Sector 3, Bengaluru, Karnataka 560102, India, for the use of Xporta at xporta.co and app.xporta.co (the "Service"). By creating an account or using the Service you accept them. If you accept on behalf of a business, you confirm you are authorised to bind it.
1. The Service
Xporta helps exporters find overseas buyers, manage buyer conversations, run email outreach, and publish product catalogues. It uses AI to research, summarise and draft. Nothing is sent from your mailbox, and nothing is charged, until you approve it.
We may improve, change or discontinue features. We will give reasonable notice before removing a feature you are paying for.
2. Your account
You must give accurate information, keep your sign-in secure, and tell us promptly at friends@xporta.co about any unauthorised use. You are responsible for everything done under your account and for the people you invite to your workspace. You must be at least 18 and using Xporta for business.
3. Plans, usage and payment
Xporta offers a Free plan, paid plans (Starter, Pro and Max) billed monthly or annually, and pay-as-you-go packs, all priced in US dollars on our pricing page.
- Plan usage. Each plan includes an amount of usage (buyer leads, import export data and outreach), granted every billing month and reset on your next monthly date. Unused plan usage does not carry over to the next month. Weekly limits may also apply so usage stays even through the month. Annual plans are paid in advance and grant usage month by month.
- Pay-as-you-go packs. Packs can be bought on any plan, including Free. Pack balances do not expire while your account is open.
- Failed work is free. Usage and pack balances are used only when work succeeds; a failed or empty run consumes nothing.
- Connections. Paid plans include a set number of connected mailboxes or LinkedIn accounts, shown on the pricing page.
Cancellations and refunds are covered by our Refund and Cancellation Policy. Prices exclude applicable taxes; for customers in India, GST is added at the applicable rate. Payments are processed by Razorpay. We may change prices with 30 days' notice; a change does not affect a billing period you have already paid for or pack balances you have already bought.
4. Your data and your content
You own your data — your mailbox content, contacts, buyers, products, photographs, catalogues and brand assets ("Customer Data"). You grant us a licence to host, process and display Customer Data only as needed to provide the Service to you. How we handle personal data is described in our Privacy Policy.
You confirm you have the rights to everything you upload — including product photographs and PDF catalogues, which may be a designer's copyrighted work — and that publishing a catalogue through Xporta does not infringe anyone's rights.
5. Acceptable use — including email outreach
You agree to use Xporta lawfully. In particular you will:
- send commercial email only in compliance with the laws that apply to you and to your recipients (including, where relevant, the EU/UK GDPR and ePrivacy rules, the US CAN-SPAM Act, and India's IT Act), include an honest identity and a way to opt out, and honour opt-outs;
- use buyer and contact information obtained through Xporta only for legitimate business-to-business contact about your products, not resell it, and not use it for spam, harassment or any unlawful purpose;
- not upload malware, attempt to breach or overload the Service, scrape it, or access another workspace's data;
- not use the Service to make false claims about your products or certifications.
We may suspend sending, or the account, if we reasonably believe these terms are being broken or your sending is harming deliverability for others, and we will tell you why.
6. Connected accounts and third-party services
When you connect a mailbox, you authorise Xporta to access it through our messaging-connection provider, as described in the Privacy Policy and subject to your email provider's own terms. You can disconnect at any time from Xporta → Connections.
When you connect LinkedIn, you connect your own account, and you remain bound by LinkedIn's User Agreement. Xporta sends only what you approve and keeps to conservative daily limits, but LinkedIn decides what it allows: it may limit or restrict an account it believes is automated, and Xporta is not responsible for such a restriction. Connect only an account you are entitled to use for your business.
When you connect WhatsApp, you connect your own number, and you remain bound by WhatsApp's Terms of Service and, for a WhatsApp Business number, the WhatsApp Business Terms. Xporta reads that number's one-to-one chats (see the Privacy Policy), so we recommend a WhatsApp Business number rather than a personal one. Xporta sends only what you approve and keeps to conservative limits (a few new chats a day, spaced out, and none on the day you connect), but WhatsApp decides what it allows: it may restrict or ban a number that people report or that it believes is automated, and Xporta is not responsible for such a restriction. You are responsible for being allowed to message the people you write to, and, where the law requires, for telling your contacts that your business uses service providers to handle its conversations.
Each connected account uses credits every 30 days while it stays connected, starting on the day you connect it, at the rate on our pricing page. If a renewal cannot be paid from your balance, sending from that account pauses, and after 7 days it is disconnected. Reconnecting starts a new 30 days.
Xporta is not responsible for third-party services' availability or changes.
7. AI output
AI-generated research, drafts, summaries and product details can be wrong. They are suggestions for you to review. You are responsible for what you choose to send, publish or rely on.
8. Buyer data found through Xporta
Buyer and contact information comes from public sources and data providers. We work to keep it accurate and verify email addresses where we can, but we do not guarantee that any contact is current, correct or interested in your products.
9. Availability and support
We aim to keep the Service available and will try to schedule maintenance outside Indian business hours, but we do not promise uninterrupted service. Support: friends@xporta.co.
10. Suspension and termination
You can close your account at any time. We may suspend or terminate for material breach of these terms, with notice where practical. On termination, you can export your Customer Data for 30 days, after which it is deleted as described in the Privacy Policy. Unused credits lapse when an account is closed, except where the Refund and Cancellation Policy provides a refund.
11. Disclaimers
The Service is provided "as is" and "as available". To the extent the law allows, we disclaim implied warranties of merchantability, fitness for a particular purpose and non-infringement. We do not guarantee business results — buyers found, replies received, or orders won.
12. Limitation of liability
To the extent the law allows, neither party is liable for indirect, incidental or consequential losses, lost profits or lost data, and our total liability arising out of these terms is limited to the amounts you paid us in the 12 months before the claim. Nothing limits liability that cannot be limited by law.
13. Indemnity
You will defend and indemnify us against third-party claims arising from your Customer Data, your emails and outreach, or your breach of these terms.
14. Governing law and disputes
These terms are governed by the laws of India. The courts at Bengaluru have exclusive jurisdiction.
15. Changes to these terms
We may update these terms. For significant changes we will notify you 30 days in advance; using the Service after they take effect means you accept them.
